Super Scam: New Rules to Keep Your Super Safe
Assistant Treasurer Daniel Mulino has unveiled a set of consumer protection reforms following the collapse of the First Guardian and Shield Master Funds.

If you’ve scrolled past a social media ad promising to “unlock your super” or “supercharge your retirement” with one clever move, your gut instinct to keep scrolling was probably right. The federal government has just drawn a line in the sand against exactly those kinds of high-pressure sales and Super scam tactics.
What’s Happening?
Assistant Treasurer Daniel Mulino has unveiled a set of consumer protection reforms following the collapse of the First Guardian and Shield Master Funds. The reforms take direct aim at Super scam “lead generators” – the operators who used social media, online ads and cold calls to lure people into putting their retirement savings into risky investments.
Think of lead generators as the financial equivalent of that person at a party who corners you, insists they’ve got the “opportunity of a lifetime,” and won’t let you near the snack table until you’ve signed something. Except in this case, the stakes are your entire retirement.
Here’s what the crackdown includes:
- A ban on unlicensed real-time contact. Unlicensed real-time communication about superannuation will be banned, and licensees will need to take reasonable steps to make sure their lead-generation activities actually follow the rules. thenewdaily
- A beefed-up anti-hawking regime. The reforms bring stronger consent requirements, limit the advisor exemption to existing clients, and introduce harsher penalties for breaches. thenewdaily
As Mulino put it, these reforms are designed to disrupt some of the most damaging business models operating in the system today, targeting the moment when consumers are first exposed to harm.
Why This Matters
This isn’t just red tape being shuffled around Canberra. The human cost has been enormous. Around 12,000 Australians lost, in some cases, ALL of their retirement savings after being targeted by sales processes that looked and felt like genuine advice, according to Financial Advice Association of Australia chief executive Sarah Abood.
That last part is the kicker: it looked and felt like advice. That’s the trick. Real financial advice and a slick sales funnel can be surprisingly hard to tell apart when you’re staring at a polished ad and someone’s using all the right words.
The FAAA has been calling for this kind of action for a while, noting that consumers need stronger protections against predatory lead generation, while still being able to find the right adviser for them. There’s also an ongoing conversation about making the compensation scheme of last resort sustainable, so that the costs don’t keep driving up the price of advice for everyone else, because right now, honest advisers are effectively footing the bill for the bad actors.
How To Tell Real Advice From a Super Scam Sales Pitch
Genuine financial advice starts with your goals, not a product. If someone’s leading with the investment before they’ve asked a single question about your life, your situation, or what you’re trying to achieve, that’s a red flag.
A few things to watch out for:
- Urgency. Real advisers don’t rush you. “Act now or miss out” is a sales tactic, not a strategy.
- Unsolicited contact. If they found you (via a cold call, DM, or ad) rather than the other way around, be cautious.
- Guaranteed high returns. If it sounds too good to be true, it’s doing an excellent impression of something that is.
- Licensing. A legitimate adviser will be properly licensed. You can check the ASIC Financial Advisers Register before you commit to anything.
